CODE of PRACTICE and CONDUCT promoted by the STIRLING TOURIST ASSOCIATION for the operation of TAXIS and PRIVATE HIRE VEHICLES in the STIRLING AREA

 WHEREAS the Stirling Tourist Association (hereinafter referred to as “the Association”), which has as its Members all members of the Area Tourist Board and whose objects are the promotion of tourism in Stirling and the surrounding area in close collaboration with the Area Tourist Board, is anxious that visitors to the Stirling area receive the best welcome and attention and to this end has proposed various standards to be maintained by those providing Taxi and Private Hire Services, and

 (hereinafter referred to as “the Operator”) has expressed willingness to co-operate in achieving this objective,

 THEREFORE the Association and the Operator HAVE AGREED as follows:-

 1.   The Operator will ensure that at all times he and all drivers of vehicles supplied by the Operator for the provision of Taxi and Private Hire services will comply with the requirements specified in the Schedule annexed hereto (hereinafter referred to as “the Code”)

 2.   The Association will supply the Operator with emblems for display on his vehicles signifying that the Operator has the approval of the Association and conforms to the Code

 3.   The Association will arrange that all Members of the Association are advised of those Operators who are current subscribers to the Code and will encourage Members to recommend exclusively those Operators

 4.   In the event of the Association receiving notice of conduct by the Operator, or by any driver of a vehicle supplied by the Operator, which is contrary to the terms of Code, notice of such breach will be given to the Operator by the Association forthwith.   Any further such breach will entitle the Association to withdraw from the Operator the Association’s approval and to terminate this Agreement

 5.   The Operator may terminate at any time and with immediate effect his co-operation with the Association in terms of this Agreement, provided that he gives notice of such decision to the Association

 6.   In the event of termination of this Agreement by either party in terms of Clauses 4 and 5 hereof, the Operator shall be obliged immediately to remove the Association’s emblems from all his vehicles

 7.   All notices to be given in terms of this Agreement shall be given in writing and delivered, in the case of the Association, to the Association’s Secretary and in the case of the Operator, to the Operator’s address specified above or to such other address as the Operator may have previously intimated to the Association

 SCHEDULE of PROVISIONS referred to in the foregoing CODE of PRACTICE and CONDUCT to be complied with by the OPERATOR and all   DRIVERS of vehicles supplied by the Operator

1.   All calls to the Operator and his employees will be met with a courteous response.

2.   A vehicle of appropriate size for the number of passengers and amount of luggage will be provided.

3.   All vehicles will be clean and tidy.

4.   The vehicle should arrive promptly at the time booked.

5.   All drivers of vehicles supplied by the Operator will hold a “Taxi Driver’s Licence” as issued by Stirling Council and will comply fully with Stirling Council’s Schedule of Conditions, copies of which are supplied to all drivers annually when their Licences are renewed.

6.   When collecting passengers the driver will announce his arrival by calling at the door of the premises and not by sounding a horn in the street.

7.   Drivers will be of clean and tidy appearance and will wear a collar and tie or similar appropriate smart clothing.

8.   Drivers will refrain from smoking whilst in their vehicle.

9.   Drivers will assist with the carrying of luggage and similarly will be of particular help to disabled persons.

10.  If drivers require to use mobile phones and other radio and intercom equipment whilst driving, they will only do so provided such phones or other equipment can be used “hands free”.

11.  Passengers will be taken to their destination by the most direct route.

12.  If the Operator or his drivers are asked for advice on suitable accommodation, the passengers will be taken to the nearest accommodation appropriate to their needs.

13.  Drivers will have available at all times a sufficient supply of bank notes and cash to ensure that appropriate change can be given
